+1 on Lawful and Legal. Legal is made by statute.

 

"Is there a contract?", is the big question here. If someone has requested someone else to do something and money or 'monies worth' changes hands, then a contract has been formed. And you can't contract illegially. IE, outside the law.

 

If it was my land, then within reason, I can do whatever I want. The issue is are my actions causing harm to anyone else or causing someone to suffer loss? If not....

 

Dangerous and 'illegal' are not the same thing so just because someone is wearing wellies is of no issue. You can't fix stupid.

 

I got called to a neighbours a while back because a silver birch had fallen across a paddock fence and she wanted 'someone proper' to get involved. On the other side of the field, was a bloke who was mixing the 2 stroke with the petrol in the saw, no helmet, no boots, his wife and kids were carrying away the wood, dogs running 'round - all with the owners blessing. What can you do?

 

Nice to know I am stupid. Yes I do wear wellies but when wearing wellies instead of my chainsaw boots I modify my technique to only cutting at waist height. As for helmets I believe they give a false sense of security. I prefer to use ear muffs, engineers glasses and a proper rubber mask with filters. Maybe not politically upto H & S but works for me.

why do your where a mask and filter?? what are you doing? you can get chainsaw wellies. not sure about a hard hat giving a false sense of security, its obviously not going to help if a whole tree falls on you but will help for smaller bits, but as you say it works for ya.

My Father died at age 50 due to lungs being full of Lignum Vitae sawdust since then I have been paranoid of any sort of fine dust including saw dust and hay dust. Dont have the problem of trees falling on me there normally already on the deck I just have to get them onto the forwarder and process.
