Personally I don't care what somebody does. But if I allow you to use track which is only used for ,say road vehicles and is in good condition and you leave large potholes and destroy land drainage with your tractor and trailer and then refuse to make good I tend to look at my options. Unfortunately some people do not know how to behave in a decent manner any more.

Truth in that:001_smile:

Totally fair comment.

Quite frankly as a farmer with woodland I would tell you in no uncertain manner what you could do. Yes in the middle of summer I will have my Meindls on but in this weather it will be wellies and no I dont have any certs but still have all my limbs after 40 years of tree felling and hedge laying. Would be interested in finding out what laws I would be breaking using my chainsaw to lay the neighbors hedge.

No problem,

From you above description you would be liable for prosecution under:

Health and safety at work etc act (1974)

PPE regulations 1992

PUWER 1998 (Provision and Use of Work Equipment Regulations)

However, the most likely outcome (should you be 'caught')would be that you would be issued with an prohibition notice.

In reality you are not likely to be caught.

of course, if you were caught, you may also be charged by the HSE for the cost of the investigation.

I think if 'agrimog' was reading this, he would bang on about acts and regulations not being law, would mention something about docks and maritime stuff, and would call everyone 'sheeple'.

good on him :001_smile:

In reality you are not likely to be caught. unless you did happen to have an accident resulting in emergency services attendance, or ED treatment

of course, if you were caught, you may also be charged by the HSE for the cost of the investigation. and liable to a hefty fine

Would you really? If it's two owner occupiers working together then most of above doesn't apply
