Felling licence and 5 cubic metre rule

I am in the process of applying for a felling licence for this winter (bit late I know). I was wondering if the 5 cubic metre per quarter rule still applies on top of what the licence allows you to fell. What I mean is can I start felling now, up to 5 cube while i'm waiting for the licence to come through?

Nope you can not start felling until the licence is issued.

The five cube is for non licence applications.

I'm a bit confused by this now!

 

If you need to apply for a licence, you have to wait until the licence is issued. No problem with that.

 

If you remain with the ¼ly exemptions you don't need a licence. No problem with that.

 

If you plan to apply for a licence, can you make a start, up to but not exceeding ¼ly exemption prior to receiving the licence?

 

Or to put it another way, if you have a licence issued, can you exceed the qty of the licence condition by the amount of the ¼ly exemption?

Sorry, but I disagree. If you apply for felling of 10 cube in a quarter, you can fell up to 5 cube (for use, not for sale) in a quarter while awaiting approval for the other 5 cube. If you want to get fancy about it, apply for and get approvial for 10 cube so that the 5 cube exemption can be used elsewhere by you and/or in the holding.

 

Surely there is, strictly speaking', no such thing as a "non license application"?

When you recieve confirmation of your felling licence application it clearly states

'Whilst we deal with your application, you must ensure that felling does not start until a licence has been issued'. ( taken from a current licence application)

 

I meant less than 5m3 for 'non licence applications'

So presumably you could fell 5cuM then put in an application. The only risk would be that you'd lose your extra allowance that quarter over getting it rolled up within the agreement?

I've just been told by the local FC officer that it is fine for me to fell the 5cube before the licence comes through. Thats good enough for me!
