Start up as a sole trader

I'm presently helping my son who is 24 to start up as a sole trader. my question is if I work with him what is the best way to set up his company. I plan to work with him part time as free labour,should I just class my self as a sub contractor,an employee or maybe a partner as I have a financial interest in the company.

I understand he will require employees insurance , just want to stay on the right side of the law and the tax man.

He is just a 1 man band, so register as self-employed with HMRC. You are not being paid so not an employee. Some time ago I was made aware that family members do not come under the employers liability insurance regulations. You are quite at liberty to give your son a personal loan without any legal connection with the business. Keep things simple unless you like red tape or admin. Good luck with his business.

Thanks for the quick reply,just trying to put everything in place. Just starting out small doing trees,gardens,fencing etc. will probably get a chipper. Biggest problem is the correct vehicle. Originally my son was going to do his B & E license but I'm not sure if the 3.5T limit will be adequate for removing waste. Should we plan for now or should he do a small goods vehicle license so he can drive bigger vehicles, any suggestions.

I seem to remember if you ask a member of the public to just move one of your barriers over a bit technecially they have become an un paid employee. Or basically you need employers liability insurance even for volunteers. For one man plus one should be cheap to add to your public liability insurance.
