Over hanging trees

Hi,

A quick question about over hanging trees, if a neighbours tree is overhanging your property's you have the right (so long as you go through the right process) to prune back to your boundary, does this work the same as a neighbours tree overhanging your field? Or as there different rules?

I've always assumed that your property is yours, and whether you use it as a field, garden or football pitch is not important.

Remember, all arisings are still the property of the tree owner.

Also to add I believe that whilst pruning is aloud on your side you would still need permission to get into the tree if needed from the neighbours side and the tree needs to be left in a stable condition I have known large trees to be pruned right back to a fence line leaving the tree unstable thus needing a fell

Yes, you can - allowing for the provisos mentioned above.

 

While the arisings remain the property of the tree owner, that doesn't mean you can deposit them on his land without his consent. Chances are he won't want them so it's up to you to dispose of them.
