Protection of fungi

Prompted by a nice pic of the rare (in England) Fomitopsis with a boot in the background! ;) Ive done some searching and can't find much info on protection afforded to fungi in the UK/EU. Difficult to even find a list of rdl fungi.

So, does anyone know if there IS any protection for rare fungi? And if so what are the consequences for damaging or destroying them or their habitats?

YES, fungi are protected, like the hericium erinaceus, piptoporus quercinus and many others whos fruit bodies you cant take and whos habitat you cant destroy. They have BAP (biodiversity Action protocols) assigned to them.

Thought there must be some protection. I bet many fb's are taken and habitats destroyed all the time. What would the punishment be for this? And who would police it?

On a side note, say for instance you have a tree hosting a protected fungi, and it poses a threat to life/property etc, where would you as a 'tree manager' stand with regards work recommended? And what if for instance in making the tree safe but leaving the habitat (ie trunk) in situ was not in the fungis favour and rendered the habitat unsuitable? Would it be like removing a dead limb known bat roost from over a road, and then leaving it at the base of the tree?!

Is there wording in the legislation that allows safety to override the protection?
