A client of mine has recieved a letter today saying that the local authority has or is putting a tpo on a site of theirs it was cleared about 30 years ago and we were due to clear it again this winter  it has self set birch mainly on the site. The site has also been down as development land for around 40 yrs . They have until 18th of Sept ti object. Advice and reccomendations greatly appreciated

I’ve helped clients with a few of these scenarios. Typically the LPA make a woodland TPO to protect all trees of whatever size and age in perpetuity. In my opinion they are a misuse of the legislation.

Would be interesting to see what the situation is with your site.

A woodland TPO should only really be used if the site is a woodland. Areas orders can be in this situation if needed, in case of emergency etc. 

 

Had you told anyone that you were going to clear it again?

 

If the land is down for development (in the Council's Local Plan?) as you say then it is surprising that the head of planning for that LA has signed of the order!
