Hi Kevin, I hope you're well.

 

 

 

Having just looked into this matter with an AA member I'm pretty sure what you are doing, i.e. 'site clearance' as part of site preparation (for construction), is included in CIS and would affect any and all assisting you with such.

 

 

 

Forestry management, AKA "good arboricultural management" :001_rolleyes:, including tree safety works, would be exempted from CIS however.

 

 

 

Not sure as to the intricacies of the CIS workings I'm afraid as never been there.

Yes, you're absolutely right, mores the pity. So much for reducing "red tape" for small industry - bah!!

 

It's almost enough to put me off putting the tender in. What a shambles of admin centric non-job civil servant nonsense.

 

I asked the question, what time frame between felling and construction would qualify the felling as "associated" with the construction... 1 week, 6 weeks, 6 months, a year, 10 years? No answer, apparently, it just is. A not particularly helpful helpline!

 

Of course (in this example) if it wasn't for the planning application, there would be a requirement for a felling licence - which would make it forestry and not subject to CIS.

 

 

From what I've been told, it's thanks to the construction industry for years of abusing cash casual labour that has resulted in the CIS.

 

HMRC - putting the "great" back into Britain!

I just bill for the plant only. i,e two days, stump grinder, chipper etc "invent any machine you want".

 

No mention of the job spec on the invoice. Essentially just plant hire.

 

0% of the invoice is associated with a labour charge. Never had an issue.

Id would say you do need to deduct from your subbies. We used to carry out highways (on the motorways) for Tilhill. They were working for interoute and we were working for them , they still made the deduction from us.
