self employed to one company

Often wondered how bricklayers get away with being S/Employed , but work on site 5 days a week for same company , yet Arb related workers get pulled up for this ???

 

The example quoted to me was a building firm who had two self employed plasterers who only worked for them, on days they told them and with their equipment. When investigated by HMRC they stated they should have been employees and the amount of back tax claimed was sufficient to close the company down.

 

Probably as with a lot of things, it's what people get away with.

Thanks Paul, I was trying to find that earlier today but got in a muddle on the HMRC website. They don't make it easy!!!

 

As for why tree surgeons fall into this and builders don't? This is mainly because they will be sub-contracted for the job i.e. a bricklayer doesn't charge per brick but to complete a job such as building a house or extension. They will only put in one invoice so it will look like they will work for several companies throughout the year. Tree Surgeons tend to have at least one job per day and none will be long term at one site. therefore they will put in an invoice for day works or for the jobs they carryout (this would add up to many more invoices).
