fence it off and leave till the summer and any chicks have fledged. anythign else could be seen as disturbing a protected species and you (more than the house owner) would be in court.

Firstly you need to consider whether the tree needs to be dealt with immediately in the interests of public safety?

 

If the answer is no then cordoning off the site, signage and waiting until the the chicks have fledged and the nest is no longer used is the best option. As any action liable to disturb them would require a licence from Natural England.
