permited development for forestry building

I thought that so long as you have a cph no ( holding no ) and the plot is atleast 12.5 acres ( 5 ha) and for agricultural/ forestry purposes excluding livestock housing and 25m ( 80ft ) from road or neighbouring residential then a simple agricultural determination application form ( 6 wks to reply ). dont expect to getchange of use though at later date for house ! Most steel frame building erectors / manufacturers will handle the application for a fee or advise .

The form you need is this (forget the Chichester bit)

The building has to be less than 465 sq mtrs and you must own or have access to at least 12.5 acres (not necessarily in the same location but must be nearby). There are a few other citerea which are outlined within the from and in the post by bythamboy and also the previous link to the forestry guidance.

 

They WILL say you need to apply for planning permission but thats a load of rubbish providing you comply with what is asked on the form.

 

If you do not meet the criterea you may still get your building but will need to apply formally for full planning permission.

thanks treebloke, this is the form i completed and sent in on the 3/12/12, they have replied and said i need to apply for planning permission, i will have to speak to them again when they reopen in the new year.

my land is not 12.5 acres maybe this was the problem? However if i can manage some local woodland then i should be able to get round this.

It's difficult when your reading of the regulations says that it is permitted development but they insist you need planning permission. I had this recently and got so fed up I just ignored them and went ahead. Calling their bluff isn't ideal but I've heard nothing so far. Worst they can do is order its removal, but not an action for everybody to try.

Ive put my reply in one month ago, had no reply at all and have tried emailing for updates twice! ive been looking up on timescales that may be inplace. Anyone know that as its been over 28 days from submitting my reply with no answer if thats the period gone so i can start the building?

i applied for permited devolpment under the forestry rule. originaly if i had no objection with in 28days i can start. however i had a request for more information which i have given but 1 month later and no reply?

i was wondering if they dont reply if there is no problem?? or am i just hoping!!
