No you can do what you want to it but you have to give the council 6 weeks notice if after 6 weeks you are legally allowed to go ahead if the council has not responded. The only way they can stop you is to put a TPO on the tree although they do try it on and haggle with you.

 

Its more about letting the council know whats going on really rater than TPO work where you have to have permition befor hand.
