What is the legal "duty" owed by a business that serves another business. . . ?

The key words in my reply you quoted were legal duty.

 

Anyone bargaining on professional indemnity insurance being of any use should they land a criminal prosecution may be in for a big disappointment.

It is an interesting question, but unfortunately the reference to LOLER thorough examinations has muddied the waters, as LOLER places specific legal duties on the employer, requiring them to ensure that examinations meet specific standards.  These are duties that they can't really dodge out of, or contract out the legal responsibility to others.

 

The stump grinder example is better, as this is purely a question of service standards (and potentially civil claims) rather than legal duties.

 

..... I don't know nuffin' about service standards.... sorry.
