Any chance you could reference that point. As I was under the impression that the guidance was to avoid the making of orders wherever possible.

So, hang on. You don't like planning conditions that are unenforcable but you're happy to suggest that we condition a mandatory partnership with a consultancy company!!!??? And then expect that consutancy to blow the whistle on their developer??? To who??? I assume the high and mighty TO...

 

Any worthwile arb consultancy should include re-inspection intervals and protection evaluations in their AIA.

 

 

All parties need to work on trust. If the developer accepts the condition he should be expected to abide by it. The consultant should make it clear that his advice is to help the developer conform with the condition,not get round it. He should be prepared to blow the whistle on the developer. There would not be "high and mighty TO's" nor consultants, because there would be trust...hopefully

Thanks, though section 5.19 refers to conditions not being suitable for the long term protection of trees. Not in general terms for develoment sites.
