Sorry to derail the thread a little but i was wondering if anyone could enlighten me -

A company wishes to fell several trees on their land , the trees are not protected at this time but during the quoting process the locall tree officer decides hes not having that and places an emergency TPO. surlely there needs to be more criteria to protecting a tree or several trees other than the tree officers say so ? . im not to worried about the job my self as it was nearly 150 miles away from me but it did leave me rather intrigued

And the obvious implication is that the T.O feels they are of significant amenity value and this is what the LA is charged with protecting through this legislation. Appealing the order is your way as tree owner of asking an arbiter to assess the land charge and reverse bad decisions. If you pop your head up and say at appeal.." I just wanted to take them down!!" you will likely be ruled against. ( I guess )

i totally see your point and as said before im not particularly bothered by the tpo being placed but it does make you wonder just how polised the country is - gone are the days of being able to do as you wish with land thats righly yours . still i find my self wondering how a tpo can be placed by a tre oficer when there has been a complaint that these trees may be taken down , it has simply been decided by one person to protect trees that are comming to the end of their life and the land owner does not wish to maintain a liability . i personally believe tha the system needs to be looked into and where needed it needed changes should be made . Im still seeing developers taking down healthy trees so that they can squeze one more plot in and verry little if anything is done by the LA but roumors that several trees that are comming to the end of their life gets them hopping to protect them , thus resulting in the land owner having to maintain these trees resulting in a costly expense each year , should one of the trees shed a limb then its his pocket that will bear the brunt .

there are many ways in which to make the system better - for one i would reccomend that more common sense is to be used - for instance why TPO a small sycamore growing from the top of a bank and compramising a retianing wall and is over crowded ?? , secondly i think that as tree surgeons/ consultants we should be able to view tpo and conservation details online , i spend way too much time on the phone to the locall planners and most of it on hold . Dont get me wrong im not running the whole system down but from experience down here in cornwall it is far from strait forward .

The system doesn't TPO inappropriate trees, but TOs can.

 

I agree about being able to view all TPO and CA details online - I think this is in the pipeline for most LA's anyway. Some already do it.

 

sorry i shoud have been a little more blunt and said tree officers . i deal with one TO down here and he is spot on but dealing with the planning offices is a real PITA and tend to get alot of my time wasted
