Alterations to "Condition of Planning"

Wasnt sure where to put this, so general chat it is, unless any mods want to move it:confused1:

 

Ive been asked to put forward a proposal to the planning department for a change of condition of planning for a "Screen" of conifers that exist to the rear of a new build.

 

The house is not complete as yet and is at first fix stage, but is one of four individually designed houses. This house is No. 3 and it will be around 9 months before the builders have finished the last house.

 

The garden is 9 meters deep from the rear of the house, and the trees are against the rear hedge about 20-25 feet high with a hawthorn hedge behind.

 

The new householder wants the 3 Larson Conifers cut down but is more than happy for a new, more suitable plantation, perhaps based upon british natives, and/or small ornamentals.

 

Anyone had dealings with this before, and if so whats the best way of going about it?

 

Any help would be appreciated.

A common stipulation in planning consents in these here parts, is that once planning has been granted that no trees can be cut down until bulding regs have been signed off. However our much inlightened tree officer has now said that if a five year management plan is drawn up and the owner agrees to stick to it, this rule becomes much more flexiable, and stops total tree annihilation once the building regs are signed off.

I'd ask for a copy of the planning permission, or get one off the Council website and check which condition needs to be changed.

 

You can try to deal with it informally, but if the tree screen is specifically mentioned you will probably need to fill in an 'Application for Removal or Variation of a Condition Following Grant of Planning Permission' which you should also be able to get from the council's website. You have to pay a fee for the submission to be registered.
