Thanks all for your input.  I probably didn't explain myself to clearly. The house is "new" to us. We bought it in June.  The only covenant is the garages cant be coverted to resi, other than that, no covenants. Permited development rights have been revoked, but I presume that is just regarding the structure.

 

I think I will just go for it, buy the tree it's £700 delivered and planted and take a punt that we are within our rights. Thanks all who took the time to comment.
