Foundations of building <10% or 900mm into the RPA of a TPO tree

Hi,

So, we got planning permission for our house which was just outside of the RPA of a tree with a TPO on it.

Now, The Engineer has given me the Plans for the Foundation, and they will require use to dig appx 900mm into the RPA of the Tree with the TPO on it.

This is a relatively small encroachment, but nevertheless still going to happen.

We will have to dig a trench and backfill it with hardcore, hence the encroachment.

Can you see this not being allowed, as if so then I don't know what we can do about it. Piling is far too expensive, but that too will mean groundbeams which encroach into the RPA by circa 300mm.

Your help is much appreciated.
