Anyone here a tree officer or can maybe give me a bit of clarity regarding an area TPO?

Morning all. I'm looking for some clarity regarding an area TPO. In the description on the schedule (as seen in the picture under A1) it lists specific species. What I'm trying to aclscertain is weather the area tpo covers only the species listed or weather it covers everything within the area?

 

My gut tells me it's only the species listed that are covered but the tree officer seems unwilling to clarify it and I don't want to go doing some work when actually the trees are covered by the tpo.

When should the area category be used?

 

The area category is one way of protecting individual trees dispersed over an area. Authorities may either protect all trees within an area defined on the Order’s map or only those species which it is expedient to protect in the interests of amenity.

The area category is intended for short-term protection in an emergency and may not be capable of providing appropriate long-term protection. The Order will protect only those trees standing at the time it was made, so it may over time become difficult to be certain which trees are protected. Authorities are advised to only use this category as a temporary measure until they can fully assess and reclassify the trees in the area. In addition, authorities are encouraged to resurvey existing Orders which include the area category.

The 'First Schedule', combined with the planning portal guidance, would suggest only trees of the species listed are protected...would it not.

 

Further, anything which has grown on the site since 1956, i.e. after the Order was made (I think it states 1955,) would not be protected. 

 

I would expect the TO / Planning Officer should clarify these points if they were presented in writing, i.e. email.
