  1. By way of update, the TO came on Friday morning - in the tipping rain. He did not appear to want to be there frankly. The long/short being - he believes that the tree has sufficient amenity but given that the tree is not under ‘immediate threat’, he does not accept that it would warrant a TPO for the moment. He added that, theoretically, the developer could incorporate the tree within any development. When I suggested that the developer could simply remove the tree pre planning, he pretty much shrugged. He will ask his planning colleagues to watch out for any pre-planning application etc otherwise that’s it. So there you go folks, dont expect your LPA to rush to help.

  3. Honestly mate - can you drop the rant? I couldn’t give a flying fq what you think. You portray the average property developer as akin to Mother Theresa, well let me fill you in - they aint. For the majority, their aim is to maximise profits, which means - squeeze em in. The idea that most care about neighbours or biodiversity etc is a load of old bollocks.
  4. Quite so Twiggy. This was a probate sale so the idea probably didn’t occur to the executor/beneficiaries.
  5. Thanks again guys - very sage advice, which I shall follow. I genuinely had no idea the whole process would be quite so nuanced. I will update once the TO has done his site visit.
  6. I will send one over as soon as the wind stops blowing Peds! The TO called me back earlier - he sounded very interested and is going to pop over for a look. He said they have previously done an emergency TPO ‘within days’ and that he would alert his planning colleagues.
  7. That’s right, thanks. The tree has obvious public amenity - using the TEMPO method, and is at immediate risk - it therefore meets the criteria for an emergency TPO, according to local guidelines. There is no emotion from my side other than doing what is right for the community.
  8. AHPP - you have some serious issues Princess. Envy and bitterness is really rather unattractive. To those of you who have otherwise made constructive comments, once I thank you. I shall be on to the TO at the LPA as soon as they open this morning. No developer is going to destroy a beautiful Oak with a very high amenity to the wider public - just so he can circumvent planning law. A good day to all (except AHPP….)

  10. Hi, I’m a first time poster. In short, I live in Wiltshire and a neighbouring property has been bought by a developer. In the garden is an ancient oak (non TPOd). I fear the developer will attempt to remove the tree before seeking planning. If I call the LPA tomorrow morning, how quickly can an emergency TPO be put in place please? Assuming that the LPA is willing to protect the tree of course. Thanks
