  1. I've seen his application, he wants to cut the tree back to where he believes the boundary is but there's the original low wall between the tree and his land. He wants to grab land to put a shed on. I've spoken with the tree officer today and he said that whilst he understands my concerns they don't take boundaries into consideration but cutting the tree back that much would not be allowed anyway.

  3. The man is aggressive, I don't want to post a photo or my location. I just thought I could get some advice on whether or not the Council would allow the tree to be cut back when there is a boundary dispute. Thank you all for replying.

  5. There's already a low wall which was part of the old farm building that the boundary was taken from. I have no idea why my neighbour thinks he owns 3 metres past this wall. So far he has offered no proof of ownership, we both have the original conveyances, sight plan and our land registry title plans.

  7. Exactly, it's a young tree and what he's proposing to do is basically cut the side off it. What you said gives me hope that the tree officer will say no.
  8. The tree is Laburnum and it's approximately 4 metres in height. He wants to take branches off the side that he believes crosses the boundary. The reason he gave is that it's encroaching on his garden and he wants to put a shed on the land. His surveyor has told him it's not on his land and now the Land Registry have sent me the original deed of when the field was divided and our 2 houses were built which clearly shows the old farm building where the boundary was taken from.
  9. It was actually the neighbour who got the survey as he was so sure he wasn't encroaching and still doesn't accept the outcome. Even the surveyor thinks he's crazy. I've spoken with the tree surgeon who was going to cut the tree back and he's not going to do it now but I'm worried the neighbour will just hire someone else. The council have said it's a civil matter and if they give consent I will need to contact my solicitor.
  10. Thank you. The boundary has already been marked with pegs but my neighbour won't accept it. I'm worried the Council will let him cut the tree.
  11. Hello everyone, I hope this is being posted in the correct forum. My neighbour has applied to the Council to cut back my tree which he says is overhanging the boundary but the boundary is in the wrong place as confirmed by a RICS boundary surveyor recently. Tree has TPO. I've objected under the application but I'm worried the Council won't consider boundaries. He's 3 metres onto my garden. Any advice greatly appreciated.
