Perhaps then, there was a valid reason for serving the TPO which was identified and supported by the High Court, judicial reviewer and the Ombudsman.. . .

Thanks everyone. I plan to challenge a TPO on 27 m. high beech which is 19 metres from a conservatory and 22 from the house and am doing my homework first.

Here's an example of council (Torbay) guidance on judging wether a tree should be considered eligible for a TPO. Not a bad read and worthwhile for anyone in a battle to either work on a TPO tree or get the TPO lifted / amended.

Very welcome! I've got several TPO issues running with 2 different council areas at present. It's been a useful revision exercise for me too
