Not true, as youcan burn waste removed from elsewhere, only if the hedgecuttings have come from the land you are burning on. EA will come down on him hard.

 

why not burn when the wind is in a different direction, or at night when the council is closed!!

It's quite straight forward:

 

D7 exemption required if burning at the site the waste was generated (or get the customer to light the fire as a domestic bonfire.)

 

If it's untreated green waste such as arisings from hedge trimming, the waste code is 02 01 03 Plant Tissue AN (absolute non-hazard)

 

If it is being moved from the site where it was generated, registration on the lower tier as a waste carrier is required and a waste transfer ticket required using the code above.

 

That's all you need if it's going to a registered waste reception centre.

 

If you are batching / storing / burning at your own site you're into a whole raft of registrations and licences as a waste reception / processing centre.

 

If the council are on the case it's probably wise to abide by the regs.

If its agricultural land your burning on then you need to register an exemption with defra or ea I forget which now and that allows you to bring in and burn so many m3 a year from yoyr own jobs on your own land.

 

But he's not burning stuff from his own land.
