Using a chainsaw in a public place

hmmmmm an individual that took it upon himself to use his chainsaw to cut fallen wood in a public place for his own gains (the wood). An argument could be made that it was being done free of charge for the community to clear said branch.

 

If he is doing it for the wood its hard to see how you can make a case for community activity.

 

If he cut the timber off the path and left it all behind then I can see that as a public minded venture but is wont take it into the HSE's remit (if that's where you are going with this tack) unless he is instructed by the LA or some sort of community body

"If the activity is commercial it must meet the HSE's requirements for PPE HSAW etc. ", no it doesnt......there is NO LEGAL REQUIRMENT FOR A PERSON OPERATING THERE OWN PROPERTY TO COPMPLY. to many of you sheeple have been brainwashed by big brother, your own property, you can do what you like

You have a duty of care to everyone, including yourself but that notwithstanding can you show me where it says he is on his own property????

In all honesty, I doubt there's much to be done about it if he's cutting up deadwood/ripped out branches (whilst also clearing a right of way).

If however he is cutting live wood, then that could be deemed as criminal damage.

You could give Andy Williams at Norfolk CC a call, he tends to have good relationships with landowners. That said, he's probably running around like the proverbial blue arsed fly and may not have much (if any) time to dedicate to it.

The chairman of the parish council is his mate so no chance. I need legal facts to present not best practice or advisory type stuff.

 

You need to show the people in charge what he is doing and that if he ducks it up they will be liable

 

This is from another thread on here and while its not an exact match if they are aware of what he is up to they are liable if it goes wrong

You could also try going straight to the HSE with this, they prefer slam dunk on going cases and the chances of them coming running next time he breaks the saw out are remote but they may well have a word with the LA as part of an investigation
