You need a license by law, he doesn't need a license/traing or certs by law.

 

This thread's darting around a bit now, and I may have gone out of sync, but Mr Holland did indeed need training. These are the laws he broke:

 

Regulation 6(3) of the Work at Height Regulations 2005: "Where work is carried out at height, every employer shall take suitable and sufficient measures to prevent, so far as is reasonably practicable, any person falling a distance liable to cause personal injury."

 

Regulation 4(1) of the Personal Protective Equipment at Work Regulations 1992: "Every employer shall ensure that suitable personal protective equipment is provided to his employees who may be exposed to a risk to their health or safety while at work except where and to the extent that such risk has been adequately controlled by other means which are equally or more effective."

 

Regulation 4(2) of the Personal Protective Equipment at Work Regulations 1992: "Every self-employed person shall ensure that he is provided with suitable personal protective equipment where he may be exposed to a risk to his health or safety while at work except where and to the extent that such risk has been adequately controlled by other means which are equally or more effective."

 

Regulation 9(1) of the Provision and Use of Work Equipment Regulations 1998: "Every employer shall ensure that all persons who use work equipment have received adequate training for purposes of health and safety, including training in the methods which may be adopted when using the work equipment, any risks which such use may entail and precautions to be taken."

All I can see is basically he climbed a tree without harness chainsaw ppe, or tying into the tree with a flip line or similar.

 

How many times do arbs see this with other so called tree surgeons that soon get slated on here for not doing what they should.

 

I have met so called trained operators that quite frankly have scared the crap out of me watching them use saws. And these have been trained.

 

Ticket or no ticket it doesn't make you a good safe operator of a saw.

 

IMO hse have done there job in this case, just a shame it came about from a nosy neighbour than an officer seeing the job take place.

 

What would this thread be like if the bloke had died in the tree from chainsaw and not having a ticket??!!

For your information...

This climbing of trees with no PPE and one handing top handles is perfectly normal here in France.

Farmers, landscapers, any-one with balls and a love of the land at some point climbs a ladder sits in the crown and at the age of 74 does stuff that scares me witless.:blushing:

I can understand the reason for rules but the punishment was in excess of the crime in my opinion.

A bit like overstaying a minute on your parking and getting a clamp and a £100 fine.:sneaky2:

Not 'pro-rata' really is it...?

Tomorrow I will climb with only lightweight outdoor trousers under my harness due to the heat.

Go on...tell my Mum why not...:001_tt2:

As Ive already said, I could run around all day worrying as to whether everyone else is adhering to the letter of the law. But....you know what, it makes absolutely no difference to me how they choose to operate. They are not competing on my kind of jobs, they make a professional team look even better. Yes he broke the law, but he didnt steal from my mum, there really is much more to life than this. Petty petty petty.

Seen this in the Daily Mail... Something it didnt pick up on was the fact the guy is using a topper which is apparent from the photo. Wonder how an untrained operative got his hands on that.... To many arborist in the trade who complain when they see people using toppers without their tickets but will go the next day and buy their friend one.

 

Amazed by the apparent fact that even after a £6,000 fine he went out and did all the relevant training!!!

 

What the hell am I doing wrong? :confused1:

It's EASY to get one without being trained, and it doesn't have to be through someone who is trained. Absolutely nothing stopping you ordering online regardless of checks that people think should be made. It's not like buying a gun!
