Can't believe what the council arb report concluded.

Does this look like a 50/50 distribution? Lol. 

 

What would look at as the next step? If not felling, I'd want at least the top part cutting back to the main trunk to stop further growth and lean onto our side as a minimum

not saying the OP can't talk to their neighbour, but if there is a difficulty there could be a gap in the market 'garden law intermediator' for knowledgeable and affable types .

I’ve thought about offering an all in one boundary service for warring middle Englanders, held up sales etc. Some sort of mediation, determination or even toothy ish legal ish assertion and then plant a hedge, build a fence etc. Including concreting in steel marker pins or leaving survey nails as indelible reminders to not steal anyone’s ten inches of driveway. I’d get to use a theodolite, which I enjoy. And hopefully just foster a bit of peace in the world.

Not really, there's a world of difference between a TO recommending a TPO be put on a tree, for which there is an appeal process, and refusing an application, with his reasoning, on an existing tree, for which there is no appeal available.

 

The OP initially failed to mention there was a TPO on the tree.

 

If he has deep pockets he can abate the trespass and we can then have a precedent of what level of nuisance overrules a TPO in the legislation.
