Unauthorised tree work in CA.

The reason / purpose of the CA is relevant. 

 

At the risk of appearing to “flip”, I am currently supporting some (quantified) tree removal in a CA as part of a planning ap. 

 

The CA was specifically initiated to protect the historic and architectural value of a coastal fishing village and, in my interpretation, is being misapplied to otherwise low amenity value trees in an attempt to stifle a development opportunity where all other planning obstacles have been overcome and, as is not uncommon, the last vestige of objection has fallen to the tree issue. 

 

Im gonna stick with a ‘general’ stance of being in favour of brining potential transgressions to the attention of the appropriate authority - and leave them to decide - but more than happy to concede that individual circumstances may give rise to personal interpretations. 

 

Are many of the AT massive subscribed to the Tree Warden scheme?

 

We’re out there in the sticks every day, I think we’ve got a lot to offer by way of observation and reporting of pests and diseases for example.

Funnily enough I'm asking my Nat parks TO about the tree warden scheme tomorrow! 👍

I’ve been signed up for many years. Neither the Parish nor County council had any interest or offered any assistance in the early days (despite both ‘supposedly’ have policies and webpages to the contrary) I went direct to UK Tree Council to sign up. Been some good CPD over the years. Really should try and give it some more attention. If you get no luck at a local level, go direct to Tree Council via their webpage 👍🏻

We dont get to “choose” which laws we “agree with.” It’s part and parcel of enjoying the liberties of a free society - there are certain inferred responsibilities. 

 

Which laws that are broken are suitable to report to the appropriate authorities? Theft? Arson? Murder? All OK?

 

Speeding? Drink driving? Shoplifting?  Planning? Not OK??

 

Living in fear of retribution? Christ alive, you’d be a prisoner in your own living room. 

 

Its the law breakers that should live in constant fear of discovery, not the good citizen - heaven help us! 🙄

Nicely put. But we get the society we choose to create and tolerate. Unfortunately we have to share it with folk who don't even respect the rule of law. No wonder the UK is going to pot. Individuals are adept at justifying their own wrongdoings to themselves, and the collective effect is a steady crumbling.

As I think you've said elsewhere, there's no good complaining about any criminal activity if you're picking and choosing what laws are right or wrong yourself. Not you, obviously, you appear to have  a backbone.

would the outcome for the tree in question have been the same if the op had gone down the correct paperwork route?? iam not that familiar with uk tree law.

...at least it was removed and not left looking like any of these!
Not in a CA - but who the heck can do this, be proud of their work and ask the customer to pay them for it!
