I have 5 garden/grounds contracts for a growing residential care home business that i am finding difficulty in getting someone reliable /trustworthy/efficient etc to carry them out, how would i go about selling the contracts ? all 5 are worth £38000, regular visits , 12 months of the year, payment via bacs, none of them are rocket science, seasonal baskets/pots etc, grass cutting, beds and borders, hedge cutting/leaf clearance, all  have compost areas, all based hampshire.. any thoughts, just need to keep them looking smart all year round

Cheers

Can you actually sell the contracts without the clients consent?

Is there anything in the contract that allows its sale or novation to a third party without the clients consent?

This is something i wil look into

Subcontracting would be one option and subject to the subbie doing the job properly so there is no  reputational risk and it was done on a pay when paid basis would control finances.

Defaulting on a contract (depending on the terms of that contract) opens the risk of claim for breach so I would be a bit nervous about that.

Definitely not a force majeure situation - that’s typically earthquakes, wars etc.

If you can’t service a £38k pa job that suggests to me that it can’t be profitable enough or other work has been taken on which is easier/more profitable.

Bit risky using words like 'definitely' when we haven't seen the contract.

Also, I'd suggest there is no generally accepted definition / level attributed to force majeure - I mean, it doesn't have to be a meteorite strike to qualify, it could be as simple as a change in medical or personal circumstances.

Agree the second part of your post though.

instead of trying to squeeze some cash out the contract why not give them to someone else instead. its obvious you don't want to do em yourself...   or can't for some reason..

Why must you default to your own greed before doin the decent thing and letting someone who can and wants to, take on the job without the expense of buying work for themselves..

I've never understood this selling rounds business..  or buying em for that matter..

finders fee's are another concept that drives me round the bend..   if I know someone that wants a job doing and I know someone willing to do it..  I'm more than willing to pass on the info without the need to stiff em for ten percent of their wages..

So if someone spends a few years building up a business then they should just give it away for free,That just the way it is.
