Hey Paul, been around saws for years and would say i’m pretty competent but not a pro by any stretch. I have cut quite a lot of trees up for people previously but not been in the predicament where the public would come in to such close proximity. Was pretty sure i’d made the right call on this one, but i guess others would of carried on regardless. I do enjoy it tho emoji39.png

Understand completely, just keep being selective and minimize the risk.

Tc,

Paul

Paul, I'm sure that every farmer I've ever met has taken everything that you've just said into consideration, before hitching up his jeans, pulling his wellies on and picking up his 'Farm Boss' to cut up a fallen tree.

Where's the tongue firmly in cheek emoji? :D

With the chain sagging 4" off the bottom of the bar...?

You have a duty of care to the public, and if you discharge this duty, then you "should" not be held liable if "something" happened, insured or not. Public Liability is not a legal requirement. You should put up tape, cones and flashing lights to block off the work area, if this means obstructing the free passage of the public thats ok, put big signs up on the cones at least ten yards either side of the work zone with "Apologies for the delay, DANGER!!! Etc etc.." You should really have a person on either side to police the tape and cones as well. But then you will need employers liability cover, because you will be employing them (even if they are SE subcontractors). Take photos of the whole set up. If something happens it will not be because you were negligent and you will be legally protected. I would say get the farmer to help (for free, thus getting you off the hook for EL)...Or do as we do in rural Ireland and don't worry about it. I personally would put up signs though.

Hi all,

Assuming I have the necessary public liability insurance and appropriate PPE, without any formal CS certification, am I legally able to use a chainsaw on a self-employed basis to take care of some local residents property along with my normal gardening duties?

No climbing, just low level tidying up of fallen limbs and small trees. I would consider myself safe and proficient with experience gained from private use, and would not take on anything 'risky', other than of course the general risk of operating a chainsaw.

Any feedback would be welcome.

Many thanks,
Jim

You get your answer Jim? [emoji6]?

the ability to show aptitude and experience in the use of the equipment, .......prior to the shit hitting the fan in 98, the only way to become competent with a saw, was to actually use one, now there are " instructors" out there who have spent less time breathing than I've got hours throwing a saw about, and to comply with some shiney ass in an office, I've got to be shown how to use a saw by these people..............the perfect example of how little they know came about a few years ago when I was asked for paperwork showing comptency in operating a logosol mill, a rather one sided phone call later and a certain person was in a vehicle and off my site with a very red face...................a clear case of " I dont know what your doing, but my book says your doing it wrong"
