its not the spec that is the issue but the design of the motor.

 

Coca Cola lost a case to HMRC where they had second row seats fitted in a VW transporters and Vivaro's. The tribunal held the vivaros's were ok as vans designed to be such but the VW's were not as not real vans (mini bus)and not allowable.

Decision

The Vivaro had a dual capability of carrying passengers and cargo. However, on a narrow balance, the Tribunal held that construction of the Vivaro was primarily suited to the conveyance of goods because:

  • Its engine and transmission were mounted transversely and the driver’s position was set high, each in order to maximise the load area and load volume.
  • The mechanical components (fuel tank, exhaust, rear suspension) were packaged to allow a large flat load space floor and the Vivaro’s height was designed to maximise the load area and load volume.
  • The design and dimensions of the sliding door and the rear door facilitated loading.

All these features seemed to be more characteristic of a vehicle the construction of which was designed to carry goods. This appeal was allowed.

By contrast the Tribunal concluded that neither version of the Kombi vans were constructed primarily to be suitable for the conveyance of goods. They were both multi-purpose vehicles, intended to enable workmen to be taken to work and for goods to be carried. The mid seat section was consistent with such a multi-purpose role. The appeals in connection with these vehicles were dismissed.

But I understood the Caravelle and indeed the Combi Van were both derivitives of the Transporter Van, and if the Vivario had seats fitted in the rear, essentially it is designed to do the same job as the Combi Transporter.

P.S.

The Transporter has also surely got a high seating position, c/w transverse engine and transmission being FWD.

Ditto the red-herring of fuel tank, exhaust and suspension gobbdly-gook, since Van designers all use the same CAD packages surely?

Now if they had simply used some criteria like some minimum "x" m3 and "x" kg of cargo carrying capacity, after the seats were fitted, it might have been simpler/clearer/fairer.

Can't get it yet. Bank needed more info that I didnt' ahve time to send due to training commitments. 

 

Chip box  hasn't been built for my trailer either cos old dudes old mate is sick so he's not managed to do a thing on the trailer.... gah.... not sure when I'll have time to drop a trailer off for a week. Wonder if he can lend me one while he works on mine...

 

Pick up truck next weekend hopefully. Could have got it yesterday but finance wont give me all of it and I don't want to use my own money cos I have a massive job starting in 2 weeks which will eat 10k before it's started so I need to be a bit liquid...
