OK grass gurus! Question: old perennial, red diesel....

 

Excise Notice 75: fuel for road vehicles says:

8.9 Mowing machines

The mowing machine must be a complete vehicle, whether pedestrian-operated or ‘ride-on’. The machinery must be built into the vehicle for it to qualify under this category.

 

but then goes on to say...

 

“...Activities not accepted as falling within the definition of agriculture, horticulture or forestry include:

 

(Loads of blah)

  • the maintenance of recreational facilities, including beaches...”

So, red diesel in a mower for recreation sports pitches, no on road use between sites, legal or not? (Note - not ‘everyone does’ but is it legal?)

I would say not legal under the letter of that law however technically speaking if you where cutting pitches for sports teams who where getting paid to play would that be classed as recreation or them doing their jobs? If it is a profession is it still recreation? To go red or not to go red?
