Working without certificates etc

Does any one know whether a business or individual can purchase woodland (140 acres )and employ non certified guys without protective clothing to fell for profit? Is it legal?

Nope, it would not be legal as you would be deemed in breach of your employers duties under the H&S At Work Act 1974 and thereby subject to prosecution...potentially, and imprisonment in the event of an accident / incident where you were found negligent.

 

A short term gain is often a longer term loss...if you get that far of course!

I should point out that this is not me but some adjoining land. The guys felling come a go, wear wellington boots a no safety gear.

I say yes (but I suspect this will be a minority view).

 

Everything is legal unless it is illegal so if anyone says no, please could they explain in as much detail as possible why with sources.

An individual who owned a woodland could fell the trees for profit themselves using dodgy Chinese saws with no chainbrake & no PPE if they really wanted to (although they would almost certainly require a felling licence) however they could not employ others to do the work for them unless they were qualified & wore the correct PPE had appropriate insurance etc...
